Understanding Claims in Construction

A claim is a legitimate request for additional compensation—whether in terms of cost, time, or both—arising from changes in the terms of a contract. Claims can emerge under nearly all forms of construction contracts, with the exception of rare cost-reimbursable contracts with no restrictions.

Session 2 – Overview of Delays and Extension of Time

We turn our focus to one of the most critical and commonly encountered issues in project delivery: delays and the associated entitlement to Extension of Time.

This session will provide a structured overview of the causes of delay, the principles of delay analysis, and the contractual mechanisms that allow for time extensions.

Session 3 – Overview of Prolongation and Disruption Cost Claims

This session, focuses on a crucial area in cost-based claims: Prolongation Cost Claims and Disruption Cost Claims.

Construction projects are frequently impacted by delays and disruptions  some caused by the employer, others by external or unforeseen events. When these delays or disruptions are not the contractor’s fault, they may give rise to entitlement to additional costs. Understanding how to identify, evaluate, and present these claims is essential for protecting commercial interests, maintaining cash flow, and ensuring contractual fairness.

We will explore the key categories of quantum claims with examples, including:

  • Prolongation Cost Claims (Time-related Cost)
  • Head office overheads and profit (HOOH & P) claims
  • Disruption Cost Claims

Session 4 – Overview of Other Quantum Claims

This session, we will examine several important, but often overlooked, categories of claims that may arise during the course of a construction project. These claims, while diverse in nature, all relate to the contractor’s entitlement to additional payment due to circumstances that change the commercial balance or operational scope of the contract.

Our focus to a wider spectrum of quantum claims beyond the more frequently discussed prolongation and
disruption costs. We will be covering the following key areas:
